(On the other hand, how absurd is this? Can you say 'frivolous lawsuit'? Good… I knew that you could.)

I don't necessarily think it's that frivolous.  Sure, they should have gotten a trademark first, but if the law says they have "common-law rights" to it, then it seems legal.  The number '22' might be a little more abstract than, say, Mickey Mouse, but it's still something that could be used to identify a product.

There's a bit of info missing from the article I guess, such as when did American Eagle Outfitters start using the number on their clothing?  Additionally, what type of clothing does Hollister sell?  I've never seen any of their stores, so I'm curious as to how likely it is for someone to confuse them.

I still think the lawsuit is pretty silly, and positive I've been seeing shirts with '22' on them for more than three years.
